These Terms of Service, ("Terms" or "Agreement") are between Always Color("Always Color," "we," "us," "our" ) and you, an individual user ("you," "your," "yours"), and govern your use of Always Color owned mobile software application, websites, or extensions that have been made available for download (each, an "App," and together, the Apps) or on any Always Color owned website and any related websites or other online properties owned or controlled by Always Color (together with the Apps, the "Service").
Your use of this website,the service,the application and /or the software (each as defined below) indicates your acknowledgement of, and agreement to be bound by, these terms of service.
In order to provide the Service and the Terms, it is necessary for Always Color to process information about you and other users. Processing of this information is crucial to the Service which we provide. Our Privacy Policy, explains how we collect, use, share, and store your personal information. If you do not agree to this Agreement or to the use of your personal information in accordance with our Privacy Policy, do not access or otherwise use any portion of the Service. The Terms govern your use of the Service and include legal provisions that limit our liability, including an arbitration clause that requires individual arbitration for certain potential legal disputes, where permitted by law. By installing a Always Color product or application or using any portions of the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree to these terms,you may not use any portion of the service.
Always Color reserves the right to alter these Terms at any time in its sole discretion. When we make material changes to the Terms, we’ll provide you with prominent notice in appropriate way, please make sure you have read the notice in advance carefully. Your continued use of the Always Color services after such notification of changes to the Terms will constitute your agreement and acceptance to such changes. You may stop using the Service under the new version of these Terms if you object to the changes.

Third-Party Services From time to time, we may provide you with links to third party websites or services that we do not own or control. Your use of the Service may also include the use of applications that are developed or owned by a third party. Your use of such third party applications, websites, and services is governed by that party's own terms of service or privacy policies. We encourage you to read the terms and conditions and privacy policy of any third party application, website or service that you visit or use.
1. Our Service is intended for general audiences - No one under 8 is allowed to use the Service. To use the service, you must be at least 8 years of age or such older age as prescribed by the law of the place where you live.you must not use the service or access it in any way if you are under 8 years of age,or under any higher age of consent prescribed by your local law.
2.You use the Always Color services only for personal purposes (you may not use them for commercial purposes). You may not use the Always Color services for any illegal or unauthorized purpose. You agree to comply with all laws, rules and regulations (for example, federal, state, local and provincial) applicable to your use of the Service and your Content (defined below), including but not limited to, copyright laws. You are solely responsible for your conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, audio and video clips, sounds, musical works, works of authorship, applications, links and other content or materials (collectively, “Content”) that you submit, post or display on or via the Service.
3. You must not interfere or disrupt the Service or servers or networks connected to the Service, including by transmitting any worms, viruses, spyware, malware or any other code of a destructive or disruptive nature, or access Always Color's private API by any means other than in compliance with rules we set on API access.
4.You must not spam or submit any unwanted email or comments to any users of the Always Color services, or use web URLs in your username without prior written consent from Always Color.
5.You are not allowed to resell or charge others for use of or access to the Always Color services, or duplicate, reproduce, transfer, give access to, copy or distribute any part of the Always Color services in any medium without Always Color's prior written authorization
6. Violation of these Terms of Use may, in Always Color’s sole discretion, result in a ban of Always Color usage. You understand and agree that Always Color cannot and will not be responsible for the Content stylize on the Service and you use the Service at your own risk. If you violate the letter or spirit of these Terms of Use, or otherwise create risk or possible legal exposure for Always Color, we can stop providing all or part of the Service to you.
The Always Color Services may include virtual items or services that can be licensed for a fee, typically via an in-app purchase ("Purchased Content"). You may only license Purchased Content if you are over 18 years old, and only on a limited, personal, non-transferable, non-sublicenseable and revocable basis for non-commercial use only. If you deactivate your account, you will no longer have access to previously Purchased Content even if you later re-activate your account or create a new account. Always Color reserves the right to manage, regulate, control, modify, or eliminate Purchase Content at any time. Upon the Purchased Content being made available to you, Always Color's obligations to provide Purchase Content are deemed fulfilled
Some of the Always Color Services are supported by advertising revenue and may display advertisements and promotions. You agree that Always Color may place advertising and promotions on, about, or in conjunction with your Content. The manner, mode, and extent of such advertising and promotions are subject to change without notice to you. You acknowledge that we may not always identify paid services, sponsored content, or commercial communications as such.
The service, including, without limitation, Always Color content, is provided on an "as is", "as available" and "with all faults" basis. to the fullest extent permissible by law, neither Always Color nor its parent company nor any of their employees, managers, officers or agents (collectively, the Always Color parties") make any representations or warranties or endorsements of any kind whatsoever, express or implied, as to: (a) the service; (b) the Always Color content; (c) user content; or (d) security associated with the transmission of information to Always Color or via the service. in addition, the Always Color parties hereby disclaim all warranties, express or implied, including, but not limited to, the warranties of merchantability, fitness for a particular purpose, non-infringement, title, custom, trade, quiet enjoyment, system integration and freedom from computer virus. the Always Color parties do not represent or warrant that the service will be error-free or uninterrupted; that defects will be corrected; or that the service or the server that makes the service available is free from any harmful components, including, without limitation, viruses. the Always Color parties do not make any representations or warranties that the information (including any instructions) on the service is accurate, complete, or useful. you acknowledge that your use of the service is at your sole risk. the Always Color parties do not warrant that your use of the service is lawful in any particular jurisdiction, and the Always Color parties specifically disclaim such warranties. some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above disclaimer may not apply to you to the extent such jurisdiction's law is applicable to you and these terms of use. by accessing or using the service you represent and warrant that your activities are lawful in every jurisdiction where you access or use the service. the Always Color parties do not endorse content and specifically disclaim any responsibility or liability to any person or entity for any loss, damage (whether actual, consequential, punitive or otherwise), injury, claim, liability or other cause of any kind or character based upon or resulting from any content.
You may access other Third Party Services through the Services, for example by clicking on links to those Third Party Services from within the Site. We are not responsible for the privacy policies and/or practices of these Third Party Services, and you are responsible for reading and understanding those Third Party Services’ privacy policies. This Privacy Policy only governs information collected on the Services.
Governing Law and Venue
The Terms, Privacy Policy, and Additional Terms shall be governed by the laws of the State of California without giving effect to any conflicts of laws principles. The United Nations Conventions for International Sale of Goods does not apply to this agreement.
